Stan, I'm so glad to hear that your son escaped serious injury in that accident. He was indeed fortunate.
My car accident nightmare:I, myself, was involved in a serious one (that was not my fault) back in December 2003, and sustained several injuries even though I was wearing my seat belt. As a matter of fact, my sternum was cracked as a result.
It's amazing how one's body is moved around. Both of my knees were banged up bad, in addition to several other areas.
Fortunately, all this stuff healed up. Our public provincial insurance company declared the other party 100% at fault for causing the accident by turning left in front of me when unsafe to do so, and subsequently was given no compensation for their injuries, which were more minor than mine.
That didn't stop that person from suing me civilly though. Fortunately again, because I wasn't at fault, the insurance company (part of my coverage) hired a great lawyer on my behalf at no cost.
Also, unbeknown to me, I had a terrific witness in a car in the lane next to me, which gave the same version of events as I did.
Where I stand at this point (yes, this is still an active lawsuit even now!) is that we've just had the "Examination for Discovery" part of this case, and it's looking extremely well for me. As a matter of fact, my lawyer is hoping that the other party will now drop the case. If not, I'm looking at 2009 for when a trial can be held.
The wheels of justice grind extremely slowly.
Even if the other party drops the case at this point, my lawyer says that they will become responsible for at least $6000 CDN in costs encurred up to this point. Can you spell "nuts"? It is a very weak case, but still they have persisted.
I hope none of this sort of thing happens to your son.
